Resident Advocacy Services Guide

In accordance with New York State regulations, including Title 18 of the New York Codes, Rules, and Regulations sections 487.5(f)(5), 488.5(e)(7), and 490.5(f)(7), Adult Care Facilities are required to furnish residents with a list of agencies that provide free legal services and resident advocacy within their geographic vicinity in addition to the prescribed termination notice. This list must include names, addresses, and telephone numbers and be approved by the Department of Health. Further, New York Codes, Rules and Regulations Title 10 section 415.3, "Residents' Rights," requires Nursing Homes to provide residents with a detailed, written discharge/transfer notice that includes specific information regarding a resident's rights in this process, such as how to appeal a discharge/transfer determination and the right to be represented by legal counsel, a relative, themselves, a friend, or a spokesperson. These notices must also contain the contact information of the State Long-Term Care Ombudsman.
