Pursuant to New York State Finance Law §163.10(b), the New York State Department of (DOH) is presenting the following summary of relevant circumstances and substantial reasons why a competitive procurement was not feasible.

Description: This initiative covers Project BREATHE NY, the NYS Asthma Management in Schools and School-based Health Centers Initiative (AMSSI) and supports the adoption and implementation of evidence-based policies supportive of asthma control. American Lung Association is the creator, co-creator, and/or owner of the rights to Open Airways for Schools, Kickin’ Asthma, Project BREATHE NY, and the accompanying trainings and educational materials. As the owners of these programs ALA is uniquely positioned achieve the deliverables of this contract and is the sole source vendor for this work due to extensive infrastructure, resources, and nationally renowned expertise in implementation of technical assistance, training, and coordination of strategies proven to support expansion of guidelines-based asthma care across settings.
