#20618 WIIN- Water Infrastructure Improvements

Pursuant to New York State Finance Law §163.10(b), the New York State Department of (DOH) is presenting the following summary of relevant circumstances and substantial reasons why a competitive procurement was not feasible.

Description: Section 1459A of the Safe Drinking Water Act (SDWA), as amended by the 2016 Water Infrastructure Improvements for the Nation Act and the 2018 America’s Water Infrastructure Act, authorized the United State Environmental Protection Agency (USEPA) to award grants to states to assist underserved, small and disadvantaged communities that are unable to finance activities needed to comply with the SDWA. The Town of Bethany was approved by the USEPA to receive this federal funding. Funding will be used to cover a portion of the Town of Bethany’s Water Infrastructure Improvement Project.

The New York State Office of the State Comptroller’s Bureau of Contracts, on January 27, 2025, approved a request for exemption from giving notice in the New York State Contract Reporter for water system improvement in the Town of Bethany.

Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
