CRER # 20734 Single Source Procurement: American Indian Health Program

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible.

The New York State Department of Health Office of Health Equity and Human Rights has determined to award a Single Source Procurement to support the American Indian Program. In response to advocacy efforts initiated directly by the Tuscarora, Onondaga, and Tonawanda Seneca Nations, funding has been awarded to further support health care services. Single source is required for the three Nations selecting Article 28 providers because each Tribal Council has the right to approve the selection of the contractor to health care services either at their Nation clinics located on tribal lands or at facilities off territory.

Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
