WIC Electronic Benefit Transfer Services
Pursuant to New York State Finance Law §163.10(b), the New York State Department of Health (DOH) is presenting the following summary of relevant circumstances and substantial reasons why a competitive procurement was not feasible.
The New York State Office of the State Comptroller’s Bureau of Contracts on 6/30/2026 approved a request for exemption from giving notice in the New York State Contract Reporter for the WIC Electronic Benefit Transfer Services from Fidelity Information Services, LLC.
NYS WIC is a federally- and State-funded program carried out pursuant to provisions of the Child Nutrition Act and to federal and New York State laws, regulations, and policies. The program is funded through the Food and Nutrition Service (FNS) of the United States Department of Agriculture (USDA) and the Department’s Division of Nutrition (DON). The NYS WIC Program serves low-income pregnant, postpartum, and breastfeeding women, infants, and young children who are at nutritional risk due to medical conditions or inadequate dietary intake. NYS WIC is an adjunct to health care, providing nutrition education and prescribed food packages to the targeted population.
The reason a competitive procurement was not feasible is because this is a contract amendment with Fidelity Information Services, LLC (FIS) for the contract term 11/13/2024 to 9/12/2030. NYS WIC and FIS completed a successful conversion to FIS’s EBT system in September 2025, effectuating FIS as NYS WIC's EBT provider. This amendment will allow WIC participants to use food benefits for eligible items ordered online. This capability must be implemented by the incumbent EBT provider.
Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
