Single Source Procurement: Outside Counsel

The New York State Office of the State Comptroller’s Bureau of Contracts on December 20, 2024 approved a request for exemption from giving notice in the New York State Contract Reporter for the legal services from Clarick Gueron Reisbaum LLP.

The New York State Department of Health intends to amend contract C040191 with Clarick Gueron Reisbaum for legal representation to DOH in Community Coalition, et al. v. Mt. Sinai Beth Israel; NYSDOH; McDonald, et al. and any subsequent work arising out of the allegations in that case, for the term 2/21/2024 – 2/21/2026. A competitive procurement for this service was not feasible because CGR has been representing DOH in this matter since its inception and their attorneys have become highly familiar with the subject matter and the agency; they are the most prepared to continue to provide effective and timely responses to the lawsuit.

Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
