Pursuant to New York State Finance Law §163.10(b), the New York State Department of (DOH) is presenting the following summary of relevant circumstances and substantial reasons why a competitive procurement was not feasible.
The current server storage environment has exceeded capacity thresholds required to maintain system resiliency and a patient record system. As a result, the hospital is no longer able to ensure the consistent availability of its infrastructure. This condition poses a significant risk to patient safety and data integrity. Instances of data corruption are already being observed. This is a health and safety concern for all at the hospital. When the system fails, even for several hours, the hospital is without an electronic patient records system. If the system fails for a lengthy period, this must be reported to the Federal government, and the Department is at risk of losing the ability to operate as a hospital. Furthermore, due to the instability, the hospital cannot reliably predict its ability to recover from a major hardware or software failure. In the event of a critical incident, recovery may not be possible without the use of advanced external resources. All recommended mitigation measures—such as reducing data retention policies to minimum acceptable levels and freeing available storage space—have been fully implemented. Despite these efforts, the issue cannot be resolved within the constraints of the current storage capacity. The hospital’s virtual infrastructure, hosted on Nutanix and supporting over 120 servers, hosting numerous critical applications is essential to patient safety and care delivery. This determination follows extensive consultation with the vendor, considering the age of the infrastructure and the limitations of current disaster recovery capabilities.
The New York State Office of the State Comptroller’s Bureau of Contracts on August 4th, 2026 approved a request for exemption from giving notice in the New York State Contract Reporter for the Nutanix Virtual Infrastructure Support and Enhancement from PKA Technologies, Inc.
Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
