CRER #20676 Single Source Procurement: American Indian Health Program
Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The New York State Department of Health American Indian Health Program has determined to award a Single Source Procurement to 7 grantees.
The New York State Department of Health is required by law to ensure New York State recognized sovereign nation members have access to primary care, medical care, dental care, eye care, pharmacy, and preventative health services. This is done through the New York State American Indian Health Program (AIHP). New York Public Health Law (PHL) §201 (1)(s) requires the New York State Department of Health to “administer to the medical and health needs of the ambulant sick and needy Indians on reservations.” The proposed contracts under this single source waiver request will be with three Nations (Seneca Nation, St Regis Mohawk Tribe and Unkechaug Nation) and four Article 28 providers, which have been selected by individual Nations’ Tribal Councils.
Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
