Single Source Procurement: CRER # 20717 Just Say Yes to Fruits and Vegetables

Pursuant to New York State Finance Law § 163.10(b), The New York State Department of Health is presenting the following summary of relevant circumstances, and material and substantial reasons why a competitive procurement was not feasible. The New York State Department of Health Just Say Yes to Fruits and Vegetables Program has determined to award a Single Source Procurement to one grantee.

The New York State Department of Health Just Say Yes to Fruits and Vegetables Stellar Farmers’ Markets (JSY SFM) program operates at farmers’ markets in low-income neighborhoods and their surrounding community to provide free nutrition and cooking workshops to Supplemental Nutrition Assistance Program (SNAP)-eligible New York City (NYC) adults. JSY SFM aims to improve dietary habits by providing education and resources for planning, purchasing and preparing healthy meals that feature locally grown produce.

The New York State Department of Health intends to contract with New York City Department of Health and Mental Hygiene (NYCDOHMH) for the Just Say Yes to Fruits and Vegetables Stellar Farmers’ Markets program for the term 10/1/2023 – 3/31/2026. A competitive procurement for this service was not feasible due to the termination of federal funding for Supplemental Nutrition Assistance Program Nutrition Education (SNAP-Ed) projects effective 10/1/2025. This contract is funded with 100% federal SNAP-Ed funds which were terminated in the enacted federal Reconciliation Bill H.R.1. Funding from Federal Fiscal Year 2025 will be used to support the remainder of the JSY SFM grant contract, requiring a shortened contract cycle to reflect a budget that can be supported by remaining available funds. The final six-month budget period would support closeout activities and operation at partial capacity.

Due to the specific circumstances of this procurement and the unique qualifications of the selected firm/entity, a competitive procurement was not feasible in this instance.
