Dear Ms. Frescatore:
Thank you for your request to amend New York´s section 1115(a) demonstration, titled "Medicaid Redesign Team" (MRT) (Project Number 11-W-00114/2). The Centers for Medicare & Medicaid Services (CMS) received the state´s proposal on March 25, 2021 to implement a 30- month transfer of assets lookback period for coverage of community-based long-term care (CBLTC) services–and to exclude certain enrollees from these proposed rules. We have completed a preliminary review of your request in accordance with the requirements of Section III, Special Term and Condition (STC) #7 and have determined that the state´s application meets the requirements for a complete amendment application.
New York´s amendment application will be posted on Medicaid.gov and the comment period will last 30 days in accordance with 42 CFR 431.416(b). The state´s application will be available here
