On May 15, 2015, the New York State Department of Health (NYSDOH) sent you a letter notifying you that the Medicaid program in New York State was changing the way it provides community based long term care services. In our letter, we informed you of our intent to submit a request to the Centers for Medicare and Medicaid Services (CMS) to add recipients of the 1915c home and community based services provided through the Nursing Home Transition and Diversion waiver (NHTD) and the Traumatic Brain Injury (TBI) Waiver to the 1115 Partnership Plan Waiver. We are writing to inform you that we will now be submitting this request to CMS for services to be effective April 1, 2018.

Our goal remains to prepare Medicaid recipients and providers for new service options. Over time, all Medicaid recipients who wish to receive home and community-based long term care services will be required to join a Medicaid managed care plan or a Managed Long Term Care (MLTC) plan.

As you know, under the State´s Section 1115 Demonstration programs, Native Americans with Medicaid coverage may enroll in Medicaid managed care plans or MLTC plans but are not required to do so. This exemption from mandatory enrollment for Native Americans will continue. In addition, existing policies related to Native Americans who choose to enroll in Medicaid managed care or MLTC plans will continue. We anticipate that the addition of these two specific target populations receiving services through these 1915c waivers will have limited impact on Tribal Nations.
