New York State Department of Health Announces Court Affirms CDPAP Fiscal Intermediary Contract Award
Appeals Court Confirms Department Followed All Legal Procedures in Awarding Contract to Public Partnerships LLC (PPL) to Oversee the Consumer Directed Personal Assistance Program (CDPAP)
ALBANY, N.Y. (October 23, 2025) — The New York State Department of Health today announced that the Appellate Division of the Supreme Court, First Department, has affirmed the New York County Supreme Court's decision to uphold the award of the statewide Fiscal Intermediary (SFI) contract to Public Partnerships LLC (PPL)to oversee the Consumer-Directed Personal Assistance Program (CDPAP). After thorough review of all evidence, the court's decision confirms that the Department met all legal obligations to select the SFI and rejected claims to the contrary as "no more than an expression of hope."
"Our priority is always serving the people of New York and making sure they have access to the care and support they need," State Health Commissioner Dr. James McDonald said. "We are pleased the court confirmed the integrity of our process, which ensures that vital services under the Consumer-Directed Personal Assistance Program continue to reach those who depend on them across the state."
CDPAP is a New York State Medicaid program that allows eligible Medicaid members to choose and hire their own personal caregiver, or "personal assistant," which can include a friend or family member, provided they are not the Medicaid member's spouse, designated representative, or the parent of a CDPAP consumer under the age of 21.
CDPAP services are provided to chronically ill or physically disabled individuals who have a medical need for help with daily activities or require skilled nursing services. Personal assistants can provide any services normally offered by a personal care aide (home attendant), home health aide or nurse.
