New York State Department of Health Reaffirms Protections for Medication Abortion Access

Mifepristone Is Still Available Through Telehealth, Mail and In-Person Care

ALBANY, N.Y. (May 18, 2026) – The New York State Department of Health reaffirmed its commitment to protecting reproductive freedom and ensuring continued access to safe, legal abortion care for all New Yorkers. Amid ongoing national legal challenges and continued attacks on reproductive health care access across the country, New York State remains steadfast in safeguarding access to comprehensive reproductive health services, including medication abortion provided through telehealth, mail delivery and in-person care.

Last week, the U.S. Supreme Court extended its stay of a lower court ruling in ongoing litigation involving the Food and Drug Administration and access to mifepristone, preserving current access to the medication, including through telehealth, mail delivery and pharmacy dispensing while the case proceeds.

"Mifepristone remains a safe, effective and available option for abortion care in New York State," State Health Commissioner Dr. James McDonald said. "New Yorkers can continue to access medication abortion through telehealth appointments, by mail, and through licensed health care providers across the state."

Governor Kathy Hochul recently announced additional investments through the New York State Supplemental Abortion Provider Support Program to help providers continue offering high-quality reproductive health services statewide.

Mifepristone remains available via telehealth (via mail) and in-person.
