Compliance Information
Providers, fiscal intermediaries (FI), and agencies should review the following information to improve and better understand their compliance with EVV requirements. The materials below range from informational reference sheets and instructional documents to training and formal compliance review process details.
Mandatory Training
All provider agencies and FIs must provide training to their caregivers, agency staff, and EVV system users who submit EVV data to the New York State Department of Health (NYSDOH). All provider agencies and FIs must also provide annual refreshers to all users. Training may be delivered in any format, including instructor-led, webinars, and self-service online training.
Supplemental Instructions, Reference Sheets, and Checklists
The following instructions itemize the specific steps necessary to maintain attestation compliance.
- All agencies must submit their EVV Attestation to the EVV Program on an annual basis through the eMedNY portal. Instructions that walk through how to complete, submit, and update an EVV Attestation can be found in the Attestation Form Instructions.

The Annual Checklist is a simple list intended to help agencies ensure they continue to maintain EVV compliance each year. New agencies or agencies thay may need to revisist any areas or topics can refer to the Getting Started with EVV Checklist.
Compliance Review Process
NYSDOH reserves the right to conduct compliance reviews that may lead to the discovery of overpayments. Currently, compliance reviews cover EVV attestation and EVV data submission requirements. All provider agencies and FIs must submit complete EVV data to New York´s EVV Data Aggregator and a complete and accurate annual EVV Attestation to NYSDOH. All applicable personal care services (PCS) became subject to attestation and data submission requirements on January 1, 2021, and all applicable home health care services (HHCS) will be subject to attestation and data submission requirements beginning January 1, 2023, with the exception of sole practitioner private duty nurses (PDNs) only who will be subject to attestation and data submission requirements beginning January 1, 2024.
After a compliance review, NYSDOH will contact individual agencies that are found to be non-compliant and present an EVV Action Plan tailored to each agency's specific situation.
