Subject: American Rescue Plan Act Fund Opportunity for Assisted Living Program

Dear Adult Care Facility Administrator:

The purpose of this letter is to inform Administrators and Operators of Assisted Living Programs (“ALPs”) who are currently open and providing services to Medicaid members of a funding opportunity. As a result of the submitted State Plan Amendment (SPA) 23-0064, the Department of Health (Department) is notifying ALPs of this opportunity outlined in both the SPA and New York State Spending Plan for the Implementation of the American Rescue Plan Act of 2021, Section 9817: Additional Support for Medicaid HCBS during the COVID-19 Emergency. CMS approved the SPA 23-0064 on February 07, 2024. ALPs will have the opportunity to apply for this funding by completing an Attestation, Spending Plan, Survey and completing quarterly updates. Upon review of this documentation in alignment with SPA 23-0064, determinations will be made for initial and ongoing eligibility.

Potentially eligible facility administrators will be have access to an informational webinar to learn more about this opportunity and the requirements to participate. The Department will continue to update you as appropriate.
