Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Waivers:
- New York's Appendix K:
- On December 7, 2022 the Centers for Medicare and Medicaid Services (CMS) approved the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Appendix K Waiver Amendment. This Appendix K includes planned minimum wage-related rate increases pursuant to New York State Regulations. This impacts all counties in New York except the boroughs of New York City, Westchester, Nassau and Suffolk.
- On October 24, 2022 the Centers for Medicare and Medicaid Services (CMS) approved the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Appendix K Waiver Amendment. This Appendix K includes the Home Care Worker Minimum Wage increase for Home and Community Support Services (HCSS).
- On August 18, 2022 the Centers for Medicare and Medicaid Services (CMS) approved the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Appendix K Waiver Amendment. This Appendix K includes an April 1, 2022, retroactive effective date for the implementation of an hourly rate for HCSS RN visits and a 1% across the board rate increase for waiver services.
- On May 13, 2022, the Centers for Medicare and Medicaid Services (CMS) approved the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Appendix K Waiver Amendment. This is effective through six months after the end of the federal Public Health Emergency (PHE) for COVID-19.
- On March 26, 2021, the Centers for Medicare and Medicaid Services (CMS) has approved the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Appendix K Waiver Amendment, allowing the suspension of conflict of interest requirements to continue up to the end date of the Appendix K. Conflict of interest requirements are thus suspended until the end date of the Appendix K (i.e., six months after the end of the federal COVID-19 public health emergency). Note: prior to this Appendix K approval, the conflict of interest requirement suspension was end dated for 2/28/21. (PDF)
- March 10, 2021 - The NHTD & TBI Appendix K is an emergency preparedness and response waiver amendment to the NHTD & TBI Waiver programs. On March 10, 2021, the Centers for Medicare and Medicaid Services (CMS) has approved an extension of the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Appendix K Waiver Amendment. Among the provisions included in the Appendix K is the ability for services to be delivered using remote technology and for services to be delivered in alternate settings. With this approval, the NHTD & TBI provisions included in the Appendix K will remain until six months after the end of the federal COVID-19 public health emergency. (PDF)
