Early Intervention Program Monitoring Information
The New York State Department of Health (Department) is charged with the administration and oversight of New York State's Early Intervention Program (EIP) and for ensuring that EIP services are delivered in accordance with State and federal laws and regulations. As a component of our general supervision activities, the Department is required under State and federal law and regulation to monitor approved providers.
Programmatic Monitoring:
The Department has a contractor who conducts direct programmatic monitoring reviews. The primary focus of monitoring reviews is to monitor for compliance with PHL (Title II of Article 25), regulations (10 New York Codes, Rules, and Regulations), Early Intervention Administration Work Plan, and Department guidance governing the EIP.
There are five types of programmatic monitoring reviews:
1. Comprehensive Early Intervention Monitoring Reviews for Regulatory Compliance - Systematic review of a service provider or municipality as a provider, in accordance with NYS regulations and applicable State and Federal laws.
2. Municipalities as Administrator Reviews - Municipalities are responsible for the local administration of the Early Intervention Program. Municipalities as Administrator Reviews focus on the Early Intervention Administration Work Plan tasks in the following areas:
- Public Awareness and Child Find
- Family Centered Services
- Child and Family Outcomes
- Service Delivery and Natural Environments
- Delivery of Transportation and Respite Services
- Transition
- Administration
3. Investigative Monitoring Reviews - A specified review that focuses on a complaint, inquiry, or expression of concern regarding a specific practice or practices of a provider or municipality.
4. Quality of Screening, Evaluation Reports and Eligibility Determination Reviews - Assess the quality of provider screenings, evaluation reports, and eligibility practices.
5. Verification of Correction Reviews - Systematic focused review of a provider or municipality that evaluates programmatic and/or administrative practices for which a provider was identified as being noncompliant during their comprehensive review and received a regulatory violation.
